These Terms of Service apply to the Client (“Client”), Elefond Photography (“Elefond”), and Elefond’s appointed photographers (“Photographer”). By confirming a booking and proceeding with a photography session or project, the Client agrees to be bound by these terms.

Once the photography session or project has commenced, acceptance of these terms is deemed to have occurred through performance.

1. Deposit, Payment and Fees

A non refundable deposit is required to secure a booking. This deposit covers the Photographer’s time, preparation, and expertise, and ensures that the session slot is reserved exclusively for the Client.

Full payment of the remaining balance is required before delivery of any images or products.

Late payments are subject to an interest charge of 0.5 percent per day, calculated from the due date until payment is received in full.

Any bank transfer or transaction fees incurred are the responsibility of the Client.

2. Image Proofs and Selection

Proof images will be delivered within 2 to 6 weeks after the photography session, unless otherwise agreed in writing.

Clients are required to make their image selections within 60 days of proof delivery. A storage and administration fee of 50 dollars per month will apply for selections made after this period.

If no selections are made within 90 days, unselected images may be permanently deleted. Requests to retrieve archived proofs, if available, will incur a retrieval fee of 100 dollars.

3. Cancellations and No Shows

Deposits are non refundable and will be forfeited for cancellations made within 7 days of the scheduled session.

Any additional costs already incurred, such as venue fees or location permits, will be charged to the Client.

In the event of a cancellation on the day of the session due to poor weather, Elefond may, at its discretion, retain 50 percent of the deposit as a gesture of goodwill instead of the full deposit.

Failure to attend a scheduled session without prior notice will be treated as a no show, and all deposits and payments made will be forfeited.

4. Additional Charges and Supplementary Invoices

Any additional time, added subjects, or additional image orders requested beyond the original agreement will be billed separately at Elefond’s prevailing rates.

A supplementary invoice will be issued for such charges and must be settled before delivery of the additional images or services.

5. Rescheduling and Late Arrivals

Requests to reschedule must be made with a minimum of 3 days’ notice from the scheduled session date.

Rescheduling requests made within 3 days of the session will result in the forfeiture of the deposit.

Late arrivals will result in a reduction of the session time available. Fees will not be adjusted or refunded due to late arrival.

6. Completion Times

Image retouching timelines vary depending on the number of images selected. As a general guide, retouching is completed within 2 to 8 weeks, at an average pace of approximately 10 images per week.

Prints, albums, and other physical products may take up to 8 weeks for completion.

All timelines are estimates and may vary during peak periods.

7. Copyright, Usage and Image Integrity

Unless a copyright buyout has been purchased in writing, Elefond remains the copyright owner of all images created.

Clients are not permitted to alter images in any way, including cropping, applying filters, or modifying colours, except for images licensed under an Advertising Licence.

Images used for advertising or promotional purposes require an Advertising Licence.

The Client acknowledges that using the Photographer’s work without proper permission or licensing is a violation of copyright law.

8. Licensing and Client Usage

All clients are granted a Personal and Corporate Licence with their purchased images. An Advertising Licence may be purchased separately if required.

Categories of License & Usage Rights

“Personal + Corporate” Licence & Usage Rights • Permits the Client to use the images for personal purposes — such as display at home, sharing on personal social media accounts, or use on a personal website for self-representation. • Permits the Client to use the images professionally for company-related representation — including on company websites, internal communications, and media kits. • Images are to be used as-is with no alterations, filters, cropping or compositing unless a “Commercial + Advertising” Licence is purchased.

“Commercial + Advertising” Licence & Usage Rights • Permits the Client to use the images commercially to promote a product, service, or brand. This includes, but is not limited to, advertising campaigns, marketing materials, album or book covers, and both print and digital advertisements. • Permits third-party creative agencies to use the images as design assets for the Client’s promotional use. • Permits third-party creative agencies to alter the image - including styling, cropping, compositing etc.

All usage rights are granted by licence only. No transfer, assignment, or ownership of copyright is implied.

9. Releases, Consents and Permits

The Client grants Elefond and the Photographer irrevocable consent to photograph the Client and to copyright the resulting images.

The Client acknowledges that Elefond may use selected images for marketing, portfolio, and promotional purposes across any platform or media, including websites, social media, publications, and galleries.

All images remain the sole property of Elefond unless otherwise agreed in writing.

If the Client arranges a photoshoot involving models, children, locations, or third party vendors, the Client is responsible for ensuring that all necessary permissions, consents, and releases are obtained.

The Client is responsible for securing and paying for any permits, licences, or rights required for the shoot. Any claims, fines, or disputes arising from missing permissions or improper usage will be the responsibility of the Client, who agrees to indemnify and hold Elefond and the Photographer harmless.

10. Use of Independent Artists

Where Elefond arranges hair, makeup, or styling services, these services are provided by independent artists.

Elefond is not responsible for any issues arising from the use of these services, including allergic reactions or sensitivities.

Clients must inform the artist directly of any allergies or concerns prior to the session.

11. Artistic Rights, Editing and Image Selection

The Photographer retains full artistic discretion over image selection, composition, and editing style.

Images not selected for delivery will not be made available.

Basic retouching and editing are included as part of the service. Requests for additional or specialised retouching may incur additional fees.

Unless otherwise agreed in writing, the Client may not reject images based on artistic style, composition, or editing choices. Additional editing requests may be accommodated at an added cost.

12. Failure to Perform, Reshoots and Emergency Substitution

If Elefond is unable to complete a session or project due to unforeseen circumstances such as illness, emergencies, natural events, or other causes beyond reasonable control, both Elefond and the Client will make reasonable efforts to reschedule the session.

If rescheduling is not possible, Elefond will refund the booking deposit in full. No further obligations or liabilities will apply.

In the event that images cannot be delivered due to technical failure, equipment malfunction, or image loss not caused by negligence, Elefond’s liability is limited to either reshooting the session or refunding the booking deposit. No additional compensation will be provided.

If the assigned Photographer becomes unavailable, Elefond reserves the right to appoint a substitute photographer of similar standard and experience. If the substitute photographer is of a lower rate, a credit will be issued to the Client for the difference.

13. Pre Production, Travel and Additional Expenses

For overseas assignments, the Client is responsible for all travel, accommodation, and related expenses, including any health or regulatory requirements applicable at the time of travel.

Fifty percent of the photography fees, along with any supporting crew or assistant costs, will be charged for pre production time spent on overseas projects.

Fifty percent of the photography fees and full associated expenses will apply for flight days, accommodation, travel days, location scouting, standby periods, and any agreed rest days.

14. Liability and Indemnification

The Client is responsible for ensuring that all images are used in accordance with the agreed licensing terms.

The Client agrees to indemnify and hold Elefond and the Photographer harmless from any third party claims, losses, damages, or expenses arising from improper usage, unauthorised distribution, or misuse of the images.

15. Legal Terms

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Singapore.

Email, messaging, and mobile communications shall be considered legally binding unless otherwise stated in writing.
